Terms of Service
These Terms of Service govern the access and use of the Faturei Hoje platform, operated under CNPJ 06.067.804/0001-94. By creating an account or using any feature of the platform, you declare that you have read, understood, and fully agree to these terms.
1. Definitions
Platform: the Faturei Hoje system, accessible via web browser and WhatsApp integration, including all modules, portals, and related APIs.
User: any individual or legal entity that creates an account on the platform.
User Content: all data, documents, images, texts, and information entered by the user into the platform.
Module: a niche feature sold separately from the subscription plan (e.g., FH Encomendas), which may be free or paid and can be activated regardless of the contracted plan.
Resident: an individual associated with a unit of a condominium managed by the user through a niche module (e.g., FH Síndico / FH Encomendas), who is not the account holder and does not contract the platform directly.
2. Account and access
To use the platform, you must create an account providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials and for all activities performed under your account.
The platform offers a 7-day free trial period, during which all features are available without requiring payment information.
3. Permitted use
The platform must be used exclusively for business and professional management purposes, including:
- Client management, scheduling, and work orders
- Financial control, quote generation, and reporting
- Client communication via integrated features
- Team management through dedicated portals
- Managing condominiums, units, and residents through niche modules, when contracted
4. Modules
In addition to the subscription plan, Faturei Hoje may offer modules: niche features sold separately, available even on accounts on the free plan. A module may be free or paid, and its activation and deactivation are performed by the user in the dashboard or requested from support.
By activating a paid module on an account that does not yet have an active subscription with a payment provider (for example, an account on the free plan), the user agrees that a real recurring charge is created, corresponding exclusively to the value of the contracted module. The rest of the plan remains free of charge until the user contracts a paid subscription through another means.
Non-payment of a separately charged module may result in automatic deactivation of the module, without affecting the rest of the account. Cancelling the only paid item on an account that was on the free plan ends the recurring charge and returns the account to a free, local-only status, with no additional charges.
5. Prohibited use
The following is expressly prohibited:
- Using the platform for illegal or fraudulent purposes
- Transmitting malicious content, viruses, or destructive code
- Attempting to access systems, data, or accounts of other users without authorization
- Reverse engineering, decompiling, or extracting the platform's source code
- Using the platform for spam or unsolicited bulk communications
- Reselling, sublicensing, or redistributing access to the platform without prior authorization
- Registering residents or sending WhatsApp communications to residents without their consent or without legal authorization to process their data
6. Intellectual property
The platform, including its source code, design, brand, logos, and documentation, is the exclusive property of Faturei Hoje. No intellectual property rights are transferred to the user through use of the platform.
User Content remains the property of the respective user. By entering content into the platform, the user grants Faturei Hoje a limited, non-exclusive, revocable license to store, process, and display such content solely for service delivery purposes.
7. Payment and subscription
After the free trial period, continued access to the platform requires a paid subscription or a paid module. Plan and module pricing and conditions are available on the checkout page or the modules area of the dashboard.
Payments are processed by third-party providers (Stripe and/or Asaas) and are subject to those providers' terms and privacy policies.
Billing is recurring and will be automatically charged at the beginning of each contracted period (monthly or annual), unless previously cancelled. Paid modules activated on a free-plan account follow the same rule, charging separately only the module's value.
8. Cancellation
Users may cancel their subscription or a paid module at any time directly from the platform dashboard, without penalties or fees.
After cancellation, access to paid features will be maintained until the end of the already-paid period. After that, user data will remain available for export for 30 days.
After the 30-day period, data may be permanently deleted from our systems.
9. Third-party integrations
The platform may integrate with third-party services, including WhatsApp (Meta Platforms), Google Calendar, Open Finance providers, and payment processors. Use of these integrations is subject to the respective providers' terms of service.
Faturei Hoje is not responsible for the availability, accuracy, or security of third-party services.
10. AI Assistant (WhatsApp)
The AI assistant available via WhatsApp processes text and audio messages to execute actions on the platform on behalf of the user. Messages are processed by third-party artificial intelligence models.
The user acknowledges that the AI assistant may occasionally interpret instructions inaccurately. The user is responsible for verifying actions performed by the assistant.
11. Resident data (niche modules)
When using a niche module involving condominium management (e.g., FH Síndico, FH Encomendas), the user enters resident data into the platform: individuals who are not account holders or party to this contract, but whose data is processed in the context of condominium administration.
In these cases, the user (property manager or administering company) acts as the data controller for residents' data under the LGPD, and is responsible for obtaining, where applicable, the resident's consent to receive WhatsApp communications, and for keeping that consent up to date. Faturei Hoje acts as a data processor, handling this data only to enable the contracted module's features (e.g., package arrival and pickup notifications).
The platform provides residents with an opt-out mechanism for WhatsApp communications, accessible via a link sent in the messages themselves, which must be honored. Further details on collection, purpose, retention, and deletion of resident data are described in the Privacy Policy.
12. Service availability
Faturei Hoje strives to keep the platform available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. The service may be temporarily unavailable for scheduled maintenance or due to factors beyond our control.
13. Limitation of liability
The platform is provided "as is." Faturei Hoje is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Data loss resulting from the user's own actions
- Business decisions made based on platform information
- Interruptions caused by third-party services
- Misuse, by the user, of resident data processed through niche modules
Faturei Hoje's total liability, in any case, is limited to the amount paid by the user in the preceding 12 months.
14. Changes to terms
Faturei Hoje reserves the right to modify these terms at any time. Changes will be communicated via email and/or platform notification at least 15 days in advance. Continued use of the platform after the effective date of changes constitutes acceptance of the new terms.
15. Governing law
These terms are governed by the laws of the Federative Republic of Brazil.
